General Liability Team to Present Webinar on New York’s Serious Injury Threshold

New York, N.Y. (October 11, 2023) – Lewis Brisbois' National Managing Partner Gregory S. Katz and New York Partners Nicholas P. Hurzeler and Sheryl S. Fyffe will present a webinar titled, “Latest Developments in How to Successfully Use New York’s Threshold Statute in Cases Where the Plaintiff Undergoes Surgery,” on October 26 at 3:00 p.m. ET.

This informative presentation will cover recent rulings and verdicts in New York that helped to expand the state’s “serious injury” threshold defense against claims brought by plaintiffs who undergo surgery following motor vehicle accidents. Pursuant to New York insurance law, a plaintiff who has not suffered a serious injury – defined as one of nine categories of injuries, including death, dismemberment or significant disfigurement.

Mr. Katz serves as co-chair of the firm’s General Liability and Transportation Practices. He is a member of the American Board of Trial Advocates (ABOTA) and has over 20 years of experience in defending cases in state and federal court. He also formed and oversees the firm’s 24/7 Rapid Response On Call Transportation Team.

Mr. Hurzeler is a Vice Chair of Lewis Brisbois' Appellate Practice. He focuses on appellate work, motions, and trials and has briefed and argued over 130 appeals in the New York State Appellate Divisions and Second Circuit Court of Appeals, with a strong track record of success.

Ms. Fyffe focuses her practice on commercial motor vehicle, premises liability, and dram shop cases and has experience representing clients in a variety of employment discrimination matters. She handles all aspects of civil defense, with an emphasis on complex and high exposure litigation, including motor vehicle, transportation, premises, and commercial liability claims.
