Scott McClure is a partner in the Phoenix office of Lewis Brisbois and a member of the Business Practices Practice.
Scott is experienced in all phases of practice with emphasis on civil litigation and product liability, including defending and advising worldwide manufacturers and retailers of heavy construction and mining equipment and battery manufacturers, and other consumer products, against lawsuits and claims of wrongful death and catastrophic injury alleging design defects, negligence, and failure to warn, as well advising and defending manufacturers of formed metal and concrete fabrications for large public infrastructure projects and bridges. Scott also has extensive experience with defending claims related to airplane crashes, vertical shaft mining accidents, industrial and commercial construction site accidents, alleged OSHA violations, alleged Mine Safety and Health Administration (MSHA) violations, alleged highway construction and design claims, balcony collapse claims, construction defect claims, architectural/engineering design and delay claims, construction delay claims, commercial disputes, business interruption, premises liability, and general liability.
Scott has extensive trial, arbitration and litigation experience defending professional liability claims related to the design and construction of major Las Vegas hotel and casino projects, and other related entertainment venues, commercial disputes, catastrophic bodily injury and wrongful death claims, including deep shaft mining accidents and related MSHA claims, construction site accidents and accidents arising out of faulty construction and design and related OSHA claims, accidents arising out of the use of heavy construction and mining equipment, construction defect and professional liability claims arising out of residential, multi-unit and commercial projects, premises liability, and extensive state and federal jury trial experience defending against criminal allegations of money laundering, bribery, public graft, financial fraud, and homicide.
Throughout his career, Scott has consistently obtained favorable results for his clients, including having tried in excess of fifty cases to verdict. By way of example, Scott successfully secured dismissal of a $55,000,000.00 lost revenue and property damage claim brought by a major Las Vegas hotel and casino against a design-build client arising out of a four day power outage. He also negotiated the dismissal of a $6,000,000.00 lost revenue and property damage claim brought by a New Orleans based hotel and casino arising out of a two day power outage against the same design-build client. And, most recently, he has obtained a defense verdict and dismissal of claims in two separate trials arising from a wrongful death involving construction equipment and an alleged design claim for property damage. Scott is an active and aggressive litigator on behalf of all his clients.
