Scott Cousins and Minyao Wang Representing Retailer Polished.com Inc. in Ch. 7 Bankruptcy

Wilmington, Del./New York, N.Y. (March 12, 2024) - Wilmington Partner Scott D. Cousins and New York Partner Minyao Wang have been retained to represent Polished.com Inc. in its Chapter 7 bankruptcy proceeding.

Founded in 1951 as Goedecker's, Polished was a large retailer of appliances, furniture, and home goods. The company operated a showroom in St. Louis and expanded into online sales in 2008. After acquiring Appliances Connection in 2021, Polished evolved into a growth-oriented ecommerce platform offering core, premium, luxury and private label brands. In 2022, Polished reported revenue of $534.47 million.

In late February, Polished suspended its operations and announced its intention to declare for Chapter 7 bankruptcy, after it was unable to secure additional financing to maintain operations. Mr. Cousins and Mr. Wang will counsel Polished through the Chapter 7 liquidation process.

Mr. Cousins a member of the Complex Business & Commercial Litigation and Real Estate & Land Use Practices. He has over 30 years of legal experience. He has been involved in many of the largest and most complicated business reorganizations, out of-court restructuring matters, workouts, liquidations and distressed acquisitions and sales in Delaware’s federal and state federal courts, as well as in other jurisdictions across the country. Mr. Cousins has decades of real-world experience representing public and private companies, creditors and statutory committees, trustees, purchasers and boards of directors, management and shareholders in all aspects of business reorganization and restructuring, including high-stakes litigation and commercial transactions related to distressed acquisitions and sales inside and outside Chapter 11.

Mr. Wang is a partner in the New York City office of Lewis Brisbois and a member of the firm's Complex Business & Commercial Litigation, Bankruptcy & Insolvency, and China Practices. He specializes in bankruptcy and commercial matters. He has 15 years of experience at both the trial and appellate levels. Mr. Wang has achieved high-stakes victories in bench and jury trials, as well as arbitrations. His clients have included Fortune 500 companies, hedge funds, institutional investors, insurance companies, start-ups and high net-worth families in the United States. He has recovered, on behalf of his clients, billions of dollars from some of the largest banks, financial institutions, and auditing firms in the world. Mr. Wang regularly represents international clients and has been quoted extensively in the legal press about cross border legal issues.
