Kenneth Feldman Recognized as Top Professional Responsibility Lawyer by Daily Journal

Los Angeles, Calif. (March 9, 2023) - Los Angeles Partner Kenneth C. Feldman has been recognized by the Daily Journal as a Top Professional Responsibility Lawyer of 2023 in its second annual list highlighting the top performing California attorneys in legal malpractice matters and judicial representation. This is the second consecutive year that he has received this recognition.

As part of this Daily Journal special report, Mr. Feldman, who is currently on sabbatical, was interviewed by the publication about notable cases he has worked on in the past year. Along with fellow Partner David D. Samani, he represented Niranjan Fred Thiagarajah, an attorney who represented the alleged sexual assault victim of (now former) Los Angeles Dodgers star pitcher Trevor Bauer. Mr. Feldman used California’s anti-SLAPP statute to show the court that Mr. Thiagarajah’s comments to the Washington Post were protected by the First Amendment, which resulted in a dismissal of Mr. Bauer's claims.

The interview describes additional matters where Mr. Feldman persuaded the court to grant anti-SLAPP motions, including a malicious prosecution case last year and another defamation case filed in federal court. According to Mr. Feldman, plaintiffs might think twice before suing opposing counsel for malicious prosecution due to the mandatory fee component of California’s anti-SLAPP statute, for prevailing defendants.

Mr. Feldman also discussed a recent win on demurrer that he and Mr. Samani were able to secure by citing one of his own appellate wins from more than 30 years ago, in which he established that legal counsel functioning as union agents during collective bargaining are immune from liability.

“It’s nice to create favorable law and then for me, my firm and other members of the legal malpractice defense bar to use those precedents,” said Mr. Feldman to Daily Journal. “I like participating in the advancement of the law.”

Mr. Feldman is a past long-time national chair of the firm’s Legal Malpractice Defense Department. Co-author (with Mr. Samani) of the California Legal Malpractice & Malicious Prosecution Liability Handbook, he is a certified specialist in legal malpractice law by the California State Bar and was the chair of the California State Bar Legal Malpractice Law Advisory Commission from 2018-2019.
