Elysian Kurnik is an associate in the Temecula office of Lewis Brisbois and a member of the Real Estate & Land Use practice.
For the past five years, Ms. Kurnik has focused her law practice on real estate transactions, including land use matters and related entity work. Her experience includes purchase and sale agreements, title review, commercial leasing, easements, land splits, and permit processing. Ms. Kurnik especially enjoys finding solutions to issues that arise during transactions, whether it involves a buyer and a seller, a landlord and a tenant, a developer and the City, or two neighbors.
Ms. Kurnik's relevant experience includes:
- Preparing easement agreements, including access, parking, utilities, sign, and view easements, as well as resolving easement issues. Notably, she negotiated and prepared 8 separate easement agreements for a redevelopment project that would take away freeway visibility from a hotel use
- Processing a subdivision map to create added value for a commercial property who use changed, resulting a significantly reduced parking requirement
- Preparing both buyer-oriented and seller-oriented purchase and sale agreements and managing the transaction through close of escrow
- Representing landlords with the preparation of leases and negotiation of terms, as well as terminating tenant leases.
- Representing homeowners with HOA-related matters
- Reviewing preliminary title reports as part of real property purchase transactions and working with title to remove exceptions
- Formation of businesses for family-owned business.
- Previously, her practice focused on business transactions and estate planning.
Prior to attending law school, Ms. Kurnik enjoyed a successful career in the field of land use and environmental planning, serving the private sector on projects. As an urban planner, she helped write Master Plans and Specific Plans for large-scal development projects, prepared CEQA and NEPA compliant documents, and managed numerous projects through the entitlement process. The majority of this experience was focused on projects within San Diego County, though she has also worked on projects throughout California as well as Washington, Utah and Idaho.

Volunteer for Save our Forests' Downtown Treescape Project, a project with the Fallbrook Land Conservancy to maintain trees around the community;
Previously served on the Public Relations Committee for the Rainbow Municipal Water District
