Linda Ressetar is a partner in the Dallas office of Lewis Brisbois and is a member of the Insurance Coverage and Bath Faith Litigation Practices.

Mrs. Ressetar has experience litigating a variety of cases in state and federal courts in Texas and Oklahoma, ranging from construction defect disputes to multi-party litigation involving catastrophic personal injuries. In addition to representing insurers in first-party and third-party coverage litigation, Linda has defended policyholders in premises liability and construction contract disputes.

Representative Experience

  • Prevailed in Oklahoma federal court and subsequent appeal to the Tenth Circuit on coverage action arising out of a Parret claim.
  • Obtained unanimous defense verdict in property insurance dispute tried in Bowie County, Texas.
  • Obtained defense verdict in Hidalgo County, Texas for national insurer involving claims for trespass and breach of the peace.
  • Prevailed in Texas federal district court and subsequent appeal to the Fifth Circuit in coverage dispute regarding the meaning of “common carrier” in the context of a travel accident policy.
  • Prevailed in Texas federal district court and subsequent appeal to the Fifth Circuit in declaratory judgment action to determine whether hundreds of wase and hour claims arose out of a series of related acts constituting one “Claim”. 
  • Prevailed in the Tenth Circuit on appeal involving declaratory judgment action addressing applicable “per occurrence” policy limit in underlying litigation involving numerous personal injury claims attributed to e-Coli poisoning. 
  • Obtained summary judgment for property insurer in multiple lawsuits arising out of hail and wind storm claims.
  • Prevailed in Oklahoma federal court and subsequent appeal to the Tenth Circuit on declaratory judgment action to determine whether insured’s acts resulting in numerous bodily injury claims constituted one “Occurrence” under general liability policy.
