The Lewis Brisbois eDiscovery Practice, through our proprietary approach to litigation management processes via our firm’s CE2eDS (Cost Effective, Cutting Edge eDiscovery Solutions) program, supports and confirms that commitment. Our primary goal is to keep the cost of examining the exponentially increasing volume of electronic data associated with modern litigation affordable. As a result, our clients are able to take advantage of the people, process, and technology that avoids or reduces expenses impacting their bottom line.
How do we do it? We start by determining what is proportional to the issues in the case in terms of data volume and total eDiscovery spend. We do not let data volume alone define eDiscovery spend. Finding the likely responsive data without looking at non-responsive information and looking at only as much likely responsive data as is justified from a cost benefit analysis is the goal. Workflows apply analytics to data while it still exists as extracted text and metadata. This avoids bloating the data with unnecessary processing and keeps the data footprint as small as possible. We only promote for review the data that can be reviewed in the current month and non-responsive data is moved to low cost storage. We stop review when a defensible volume of data has been analyzed. This is a unique and cost-effective approach compared to many of our peers. The industry standard is to process all eDiscovery data as soon as it is received, which often results in large volumes of non-responsive data being processed and hosted at high costs while nothing is being done with it. This can be as unproductive as renting a suite at the Ritz and sleeping at a Motel 6. This is one reason why overall eDiscovery costs can skyrocket far past initial budget estimates.
The CE2eDS approach starts from a wiser position of strength. Our team delivers the right technology for the project because the first thing we do is ask the fundamental questions to help accurately identify and determine low cost options without sacrificing functionality or operational skill. We then leverage any number of the exclusive deals we maintain with more than 30 technology providers throughout the eDiscovery space. Some are software development companies, some offer outsourced review, others offer full service collection to production, and many fall in between. We have strong and ongoing relationships with the senior management at all of them. These relationships allow us to get custom solutions not available to others, and to give our clients the best price while developing a unique, collaborative, and cost effective workflow. When needed, we create virtual eDiscovery technology providers using the strengths of two or more companies to provide optimal solutions to clients.

Carli has significant experience defending manufacturers, businesses, and insurers in product liability and commercial litigation matters. She brings a passion for client interaction and extensive experience within life sciences to her practice as part of the national counsel team serving multiple large medical device companies.
Carli routinely handles complex cases involving personal injury, class action, wrongful death, as well as neglect and negligence claims. Mr. Norris is a trial lawyer representing plaintiffs and defendants in complex commercial litigation, including litigation arising from intellectual property rights, products liability claims, contractual disputes, and a wide variety of other claims.
Mr. Norris has recovered nearly $220 million for his clients in jury trials and arbitrations to date. Mr. Norris has broad experience representing manufacturers in many types of disputes. For example, he recently served as trial counsel for a textile manufacturer in a three-week jury trial in Jacksonville, Florida, in which he recovered more than $90 million including interest and attorneys’ fees in a breach of warranty claim against a component supplier. Ms. Marshall is originally from Houston, Texas, and has been living in New Mexico since 2005. Prior to working at Lewis Brisbois, Ms. Marshall worked at a creditor's rights law firm representing financial institutions in a variety of actions including Bankruptcy, Collection, Unfair Trade Practices claims, Fair Debt Collection Act claims, and Real Estate Settlement Procedures Act claims. Jeffrey F. Yee is a partner in the Los Angeles office of Lewis Brisbois and a member of the Intellectual Property & Technology Practice. He focuses his practice on intellectual property related issues, coming to law from a chemical engineering background. He has worked on many patent infringement litigations involving mechanical design, polymer, fire retardant, pharmaceuticals, medical devices, LCD panel, thin film transistor manufacturing process, DVD technologies, smartphones, and content-based image search and webpage hypermedia. As general counsel, he handled contract negotiations for the bank’s portfolio companies; located, structured and negotiated bank relationships for the portfolio companies; handled public company offerings and related activities; participated on merger and divestiture teams; served on a number of board of directors; and counseled ownership on a variety of issues related to development alternatives and related legal issues.

Martin is admitted to the trial and appellate courts in Georgia, Washington, and the District of Columbia as well as the United States Supreme Court, District of Columbia and 11th Circuit Courts of Appeal, and federal trial courts in Georgia and the District of Columbia.
Active in the legal community and civically, Martin is a member of the environmental practice sections of the American, Georgia, District of Columbia, Washington, and Atlanta Bar Associations as well as the Lawyers Club of Atlanta. He also serves on the Board of Directors of the Savannah Riverkeeper, Inc. based in Augusta, Georgia and operating along the Savannah River in both Georgia and South Carolina. Martin has served in the past as a volunteer group leader for the Georgia Chief Justice’s Commission of Professionalism for over a decade as well as the City of Atlanta, Neighborhood Planning Unit W Executive Committee (2004-2010). Currently, he is active in his local community as a Scout Leader and youth soccer coach.
He has been named a "Georgia Super Lawyer" by Law & Politics Magazine multiple times since 2010.
A sampling of representative projects and matters he has worked on include:
- Supervision of multi-million dollar property remediation for hazardous materials under Georgia’s Hazardous Site Response Act (HSRA) and the Federal Comprehensive Environmental Remediation, Compensation, & Liability Act (CERCLA or Superfund) in metro-Atlanta.
- Supervision of multiple sites in the Georgia Voluntary Remediation Program (VRP) for hazardous materials.
- Supervision and management of legal work for management of environmental response and redevelopment of various former industrial sites for commercial and residential use under HSRA and the Georgia Brownfield Act.
- Supervision and management of legal work for redevelopment of former RCRA un-permitted landfill sites for residential and commercial use as well as managed containment of waste areas and preservation of adjacent wetlands.
- Lead counsel in litigation under CERCLA, RCRA, and HSRA related to remediation, contribution, and cost recovery for sites ranging from the corner gas station to multi-million dollar remediation sites.
- Supervision and management of legal work for redevelopment of former un-permitted landfill and mining site for commercial use under the Georgia Brownfield Program in northwest Georgia.
- Assisted a metro-Atlanta small municipality with its Notice of Intent Renewal and Annual Report under the Clean Water Act Multiple Separate Storm Sewer System (MS4) permit.
- Lead counsel in numerous Clean Water Act and state law nuisance and trespass cases regarding impacts to lakes, streams, ponds, wetlands, and other waters.
- Provided guidance and consultation in numerous real estate transactions regarding legal environmental risk assessment and Brownfields issues.
- Represented neighborhood community group in fight to preserve and protect a 30 acre intown urban forest along Peachtree Creek from residential development facilitating its eventual dedication as the Morningside Nature Preserve in the City of Atlanta.
- Assisted clients with various environmental due diligence matters including removal and closure of Underground Storage Tanks (USTs) and development of previously contaminated sites.
- Assisted clients with administrative resolution of USEPA and State enforcement actions including wetlands violations, hazardous waste handling and disposal, and lead based paint regulations.
- Assisted clients with Safe Dams Act enforcement matters and in navigating the dam remediation or reconstruction process under the law.
- Negotiated resolution of USEPA enforcement action for commercial lead-based paint disclosure violations reducing penalty from over $200,000 to less than $2,000.
