To protect consumers from abusive collection practices, the Fair Debt Collection Practices Act (FDCPA) was passed in 1977. The act provides that creditors cannot collect a debt without following very precise rules and meeting specific requirements. Failure to comply with the stringent requirements of the act may result in litigation against even the most ethical debt collection professionals.
The members of our Consumer Litigation Defense and Financial Services Group have extensive experience defending lawyers and other professionals who have been sued for violating various consumer statutes, including the Fair Debt Collection Practice Act, Rosenthal Act, Fair Credit Reporting Act, Unfair Business Practices and the Telephone Consumer Protection Act. Our attorneys are also experienced in representing financial institutions in a wide variety of matters, including unfair and predatorial lending practices, fidelity bond litigation and judicial foreclosures, and participated in the litigation of the largest fidelity bond claim in history.
