Steve Capriotti is a partner in the Philadelphia office of Lewis Brisbois and a member of the Toxic Tort & Environmental Litigation, Asbestos Litigation, and Class Action & Mass Tort Practices. He has significant experience in claims involving exposures to asbestos, benzene, diacetyl, as well as other chemical products.

Mr. Capriotti serves as National Coordinating Counsel for firm clients and has been retained to negotiate nationwide settlements and dismissals. Mr. Capriotti aggressively defends clients through diligent trial practice and preparation, motion practice and settlement negotiations. Mr. Capriotti has tried cases to verdict, as recently as 2018. Mr. Capriotti has defended the firm’s clients as lead counsel in depositions of plaintiffs, corporate representatives, co-workers, and expert witnesses.

He is responsible for defending firm clients throughout the State of New Jersey and the Commonwealth of Pennsylvania including the cities of Philadelphia and Pittsburgh.

Mr. Capriotti is licensed and practices in the State and Federal Courts in both Pennsylvania and New Jersey. 

Mr. Capriotti also has significant experience in transportation and pharmaceutical claims.

Representative Matters

  • Paul Simmons and Donna Simmons v Berryman Products, Inc. et al. - Defense verdict obtained on behalf of Berryman Products, Inc. on May 4, 2018 in the Philadelphia Court of Common Pleas.
    • Capriotti obtained a defense verdict in a benzene Wrongful Death case tried in Philadelphia County. Capriotti served as co-lead counsel in the three-week trial. His cross-examination of the decedent in a pretrial videotaped deposition was the key evidence that the jury considered in deliberations.
  • Elias Karkalas, M.D. v William Martin et al. - Capriotti has Summary Judgment granted in Motor Vehicle Accident Litigation when Plaintiff’s Expert Witnesses are Precluded in the Chester County Court of Common Pleas. In a matter involving an intersectional motor vehicle accident, Plaintiff alleged that he sustained severe injuries to his heart, as well as other injuries as a result of the accident. The defense obtained an order precluding Plaintiff’s medical experts from testifying at the time of trial based on the argument that the experts’ opinions did not meet the level of scientific certainty required to prove causation under Pennsylvania law. Capriotti then obtained an order granting summary judgment on Plaintiff’s remaining claims for “bumps and bruises,” on the basis that Plaintiff, as a limited tort claimant, failed to prove that he sustained a serious impairment of a bodily function, permanent disfigurement or death, as is required to obtain damages under Pennsylvania law.
    • The trial court’s decision was affirmed on appeal.
