Jonathan Goins to Speak at Copyright Society’s Annual Meeting on Name, Image & Likeness Issues

Atlanta Partner Jonathan D. Goins will speak at the Copyright Society of the USA’s (CSUSA) Annual Meeting, hosted at the Swissotel Chicago on June 13.  

Atlanta, Ga. (April 25, 2022) – Atlanta Partner Jonathan D. Goins will speak at the Copyright Society of the USA’s (CSUSA) Annual Meeting, hosted at the Swissotel Chicago on June 13, 2022.

In an informative 60-minute CLE session titled “Rivalry Game? Copyright, Right of Publicity and College Athletes,” Mr. Goins and his co-panelists, including counsel for the NCAA, will address the intersection of copyright and right of publicity law, specifically focusing on recent developments that permit student athletes to profit from their name, image, and likeness (NIL) and related NIL legislation. Although student athletes can now enter into sponsorship deals and profit from their NIL, they still may be prohibited from using other intellectual property owned by their schools, such as team logos, team photos, game footage, and uniforms.  Mr. Goins will also address copyright principles that may apply in NIL disputes, such as preemption, fair use, and the transformative use test that courts have applied to balance the right of publicity with the First Amendment. 

Mr. Goins serves as a Vice-Chair of Lewis Brisbois' Intellectual Property & Technology and Entertainment, Media & Sports Practices. With two decades of experience, he regularly oversees litigation matters nationally involving intellectual property, technology, and complex business disputes, as well as advising on IP rights in creation and enforcement, multimillion-dollar transactions, and large-scale portfolio registrations covering a wide variety of industries. Mr. Goins is consistently ranked in peer-recognitions and publications for his expertise in IP, including peer-recognitions with the World Trademark Review and Georgia Super Lawyers.
