Dana Fox Contributes to Los Angeles Times Roundtable Section on Trends in Trial Law and Litigation

Los Angeles Partner Dana Alden Fox recently contributed to a Los Angeles Times Roundtable section titled, “Insights from Top Litigators and Trial Lawyers,” in which he and his fellow panelists addressed how the pandemic has changed trial law and shared their perspectives on post-pandemic litigation trends.

Los Angeles, Calif. (November 15, 2021) - Los Angeles Partner Dana Alden Fox recently contributed to a Los Angeles Times Roundtable section titled, “Insights from Top Litigators and Trial Lawyers,” in which he and his fellow panelists addressed how the pandemic has changed trial law and shared their perspectives on post-pandemic litigation trends.

On the topic of how COVID-19 affected the litigation landscape in California, Mr. Fox described his experiences when trying three jury trials during 2021. He explained, “COVID protocols have made jury trials, which are always challenging to the courts and counsel, even more difficult and cumbersome. . . . But the steps taken by the courts have been designed to protect the health and safety of all of us, so they are understandable.”

Mr. Fox also discussed how social media has affected trials, stating, “Common and easy access to social media poses a challenge to the integrity of jury trials.” He explained that although courts instruct juries that they may not conduct internet research on topics related to the trial, “it can be assumed that some jurors will not follow the instruction and will conduct their own research and be influenced by others outside the trial due to the Internet and social media.”

In addition, Mr. Fox weighed in on the benefits of alternative dispute resolution, a new California law that expands the scope of wrongful death damages, and the percentage of cases that settle.

Mr. Fox serves as Co-Chair of Lewis Brisbois’ General Liability Practice. He is one of the most heralded trial attorneys in California, consistently obtaining results not thought possible for his clients, including multiple defense jury verdicts in prominent cases. As a Fellow in the American College of Trial Lawyers and a newly appointed member of the Executive Board of the American Board of Trial Advocates’ Los Angeles Chapter (LA-ABOTA), Mr. Fox routinely defends the most difficult, high exposure cases in the Golden State.
