David A. Campbell is a partner in the Cleveland office of Lewis Brisbois and a member of the Labor & Employment Practice. Although based in Cleveland, David's practice is nationwide. David represents clients in state and federal courts across the United States, including Ohio. In addition, he has represented employers in front of state and federal employment related agencies, including the EEOC, DOL, OSHA, NLRB and the OCRC. David's practice extends across many industries and includes hospitals, manufacturers, retailers, restaurants, dental organizations, and all sizes of private organizations.
David's practice focuses exclusively on representing employers in all aspects of the employment and independent contractor relationships. David has extensive experience in drafting and litigating non-compete, non-solicitation, and confidentiality agreements. His non-compete and trade secret litigation has been in state and federal courts across the United States. David's non-compete experience includes working with clients to effectively draft and administer non-compete agreements in order to effectively deter unlawful competition. Similarly, David regularly counsels clients on employment matters ranging from hiring employees to employee discharges. His counseling involves the Fair Credit Reporting Act, employee investigations, training, employee discharges, and reductions-in-force. Finally, David has extensive experience in counseling clients on the appropriate use of independent contractors. David's practice includes representing employers with respect to union-related issues. David negotiates union contracts, administers union contracts, handles employee arbitrations, and handles union-related litigation. David's union practice includes matters involving both multi-employer construction trade unions and traditional private, single employer unions.
Finally, David has extensively litigated on behalf of employers in response to discrimination, harassment and other wrongful discharge claims throughout the United States. David has argued before the Ohio Supreme Court and the DC, First, Third, Fifth, Sixth and Eighth Circuit Courts of Appeal. David is an aggressive litigator. However, based on his continuing relationships with clients, David utilizes the defense of lawsuits and charges to counsel clients in strategies to avoid future claims and to better defend such claims if they arise.
