Boston Office Obtains Favorable Outcome for Developer

Boston Partners Kenneth B. Walton and Matthew M. O’Leary and Associate Oliver J. Vega recently obtained a favorable outcome on behalf of a developer in an arbitration arising out of the construction of an apartment building in South Boston.

Boston, Mass. (April 19, 2019) - Boston Partners Kenneth B. Walton and Matthew M. O’Leary and Associate Oliver J. Vega recently obtained a favorable outcome on behalf of a developer in an arbitration arising out of the construction of an apartment building in South Boston.

The general contractor sought recovery of damages it sustained during the construction of the project in the amount of $2.4 million allegedly caused by the developer’s delays, inefficiencies, extra out-of-scope work, and violations of the Prompt Pay Act and Unfair Trade Practices Act.

After 12 days of hearings and substantial briefing, the arbitrator awarded the general contractor a total of $86,000 (3.5 percent of its alleged total damages) and directed the general contractor to repair its deficient work. The client was very pleased with the outcome.
