Lewis Brisbois wins $26 million attorney fee in favor of Barclay Hollander

Los Angeles, California, September 14, 2018 – Superior Court Judge William F. Highberger awarded $26.8 million in attorneys fees as the prevailing party to Barclay Hollander, a subsidiary of Dole Foods.

Los Angeles, California, September 14, 2018 – Superior Court Judge William F. Highberger awarded $26.8 million in attorneys fees as the prevailing party to Barclay Hollander, a subsidiary of Dole Foods. Barclay earlier defeated Shell Oil’s $400 million environmental remediation and indemnification claim relating to alleged oil contamination at 285 homes in the Carousel development in Carson, California.

Shell alleged the cost of remediation has exceeded $100 million so far, and could ultimately exceed $300 million. Shell also sought recovery of $90 million it paid to residents at the site. In an earlier bench trial, the court ruled that Barclay had no liability under a 1965 letter agreement drafted by Shell that purported to require indemnification.
