Phoenix Team Obtains Summary Judgment for National Real Estate Investment Clients

Phoenix, Ariz. (November 2021) - Phoenix Partner Gina M. Bartoszek and Associate Mitchell J. Anderson recently won a motion for summary judgment on behalf of a national real estate investment firm and its affiliates. The plaintiff in this case, who was also a plaintiff in two underlying suits, alleged breach of contract, bad faith, numerous violations of Arizona’s Landlord-Tenant Act, punitive damages, and intentional infliction of emotional distress. Following cross-motions for summary judgment and oral argument, the Maricopa County Superior Court denied the plaintiff’s motion and sided with our clients. The court granted our clients’ summary judgment motions based on res judicata, collateral estoppel, and lack of contractual privity. The court further granted summary judgment on the issue of damages.
