Lewis Brisbois is pleased to present our January 16, 2020 Webinar entitled: “BIPA, The CCPA, & Data Breaches.” Mary Smigielski and Josh Kantrow, Chicago Partners and Chairs of Lewis Brisbois’s Biometric Information Privacy Act (BIPA) Practice will discuss a variety issues arising under BIPA after an Illinois Supreme Court decision a year ago drastically reduced the threshold required for individuals to seek redress under BIPA. They will also discuss the current BIPA landscape, which includes approximately 300 class actions filed in the past 18 months, defenses, settlements/case valuations, insurance coverage implications, and attempts to pass similar statutes in other states and municipalities. Sean Hoar, Chair and Lindsay Nickle, Vice-chair of the Lewis Brisbois Data Privacy and Cybersecurity Team will discuss the California Consumer Privacy Act (CCPA), which went into effect on January 1, 2020. The discussion will address the applicability of the CCPA, critical provisions and compliance issues presented by the Act, and the potential impact of the CCPA on businesses inside and outside of California. They will also provide an overview of recent developments in the current data breach threat landscape.
