Individual Adjuster Liability for Bad Faith.” Please join us as Seattle Administrative Partner Gregory Worden and Miami Administrative Partner Seth Alhadeff discuss the developing area in insurance bad faith law of individual adjuster liability. Recently, insurance adjusters have come into the crosshairs of claimants who argue that insurance adjusters should owe independent duties to policyholders/insureds. Courts are currently struggling with the question of whether there should be an independent tort for adjuster bad faith. The presenters will discuss recent developments regarding individual adjuster liability, tactical reasons why Plaintiffs’ attorney chose to sue individual adjusters as well as insurance companies, and the impacts of such suits on adjusters. The presenters will also discuss ethical concerns raised by the conflict created when both the insurer and adjuster are subject to suit and strategies for responding to such suits. The program is of special concern to adjusters because the prospect of individual adjuster liability is an involving area of law which has the potential to impact every adjuster and to potentially influence the manner in which they do their jobs.
