Courts are currently struggling with the question of whether there should be an independent tort for adjuster bad faith. The presenters will discuss recent developments regarding individual adjuster liability, tactical reasons why Plaintiffs’ attorney chose to sue individual adjusters as well as insurance companies, and the impacts of such suits on adjusters. The presenters will also discuss ethical concerns raised by the conflict created when both the insurer and adjuster are subject to suit and strategies for responding to such suits.
