Washington, D.C. Team Secures Motion to Dismiss in Defamation Case

Washington, D.C. (November 11, 2019) - Washington D.C. Co-Managing Partner Katherine I. Funk and Associate Amanda L. Tharpe recently secured a motion to dismiss for our client, an insured’s news website that was being sued for defamation. The plaintiff asserted that our client published false and defamatory information about him as part of a conspiracy among 22 defendants to discredit the plaintiff. The case raised significant 1st Amendment questions.

Ms. Funk and Ms. Tharpe filed a motion to dismiss, arguing that the plaintiff’s claim of conspiracy against our client was not plausible. In granting our motion to dismiss, the U.S. District Court for the District of Columbia accepted our argument that the plaintiff failed to allege facts sufficient to infer participation by our client in the alleged conspiracy to defame the plaintiff.
