Mary Smigielski Quoted in Bloomberg Law Article About New Illinois BIPA Practice

Chicago, Ill. (February 14, 2019) – Chicago Partner Mary Smigielski, who is also co-chair of Lewis Brisbois’ new Illinois Biometric Information Privacy Act (BIPA) Practice, spoke with Bloomberg Law for their article “Lewis Brisbois Starts Attorney Group Around Illinois Privacy Law.”  Lewis Brisbois announced the formation of the new Illinois Biometric  Information Privacy Act (BIPA) practice group in a press release on February 13th.

Ms. Smigielski explained the reasons behind the formation of the new practice group, which was developed in the wake of a recent Illinois Supreme Court decision in Rosenbach v. Six Flags Entertainment Corporation. That decision will make it much easier for plaintiffs to bring suit under BIPA.

“It’s a new landscape for companies after the Supreme Court decision,” said Ms. Smigielski, “and the consequences for businesses are potentially staggering.”

Since BIPA allows plaintiffs to recover up to $1,000 per unintentional violation and $5,000 per intentional violation “liability for companies could be in the millions of dollars,” Ms. Smigielski told Bloomberg Law.
