Kenneth Feldman, Alex Graft Author Article for Daily Journal on 2022 Cases Involving Lawyers

Los Angeles, Calif. (January 23, 2023) - Los Angeles Partner Kenneth C. Feldman and San Francisco Partner Alex A. Graft (past National Co-Chair and current Vice Chair, respectively, of Lewis Brisbois’ Legal Malpractice Defense Practice) recently authored an article for the Daily Journal, titled “2022 in Review: Cases Involving Lawyers.” This is the 11th year in a row that they have penned a year-in-review article for the publication. The article discusses California appellate court decisions issued over the last year in a variety of matters involving lawyers as parties to the case.

The authors open the article with a discussion of several anti-SLAPP cases, observing that the anti-SLAPP statute “was a hot topic before the appellate courts in 2022,” They further explain that rulings in these matters addressed the statute’s “reach and potential for abuse,” thereby “underscoring its prominence as a tool in cases against lawyers.”

Messrs. Feldman and Graft go on to describe an appellate court ruling that resolved a split of authority concerning the funding of arbitration in legal malpractice cases involving an allegedly indigent plaintiff. In addition, the authors discuss significant decisions concerning the statute of limitations applicable to claims against lawyers, the Barton doctrine pertaining to claims arising in the course of bankruptcy, and the limits of disqualification.

Messrs. Feldman and Graft are certified specialists in legal malpractice law by the California State Bar Law Advisory Commission. Mr. Feldman was the chair of the California State Bar Legal Malpractice Law Advisory Commission from 2018-2019. He is also the co-author of the California Legal Malpractice & Malicious Prosecution Liability Handbook. Mr. Graft's practice focuses on the defense of attorneys and other professionals, including insurance agents and brokers, accountants, architects, real estate agents and inspectors, as well as licensed security officers, in litigation matters.
