Katherine Compton Publishes Trademark Litigation Article in Texas Bar Journal

Dallas, TX (January 18, 2019) - Dallas Partner Katherine Compton recently penned an article for the Texas Bar Journal about a trademark litigation suit brought by Viacom International against IJR Capital Investments for infringing on its common law trademark of the Krusty Krab, a fictional restaurant from the animated television show SpongeBob SquarePants

Viacom had learned that IJR was planning to open restaurants in Los Angeles and Houston called the Krusty Krab, and that the U.S. Patent and Trademark Office had approved its applications to use the name. Viacom brought suit in the Southern District of Texas and filed for summary judgment, which was granted. IJR appealed and, in May 2018, the U.S Court of Appeals for the 5th Circuit ruled on the case.
