John Parks Quoted in Law360 Article on Upcoming Airline Merger Bankruptcy Trial

Denver, CO (January 15, 2019) – Denver Partner John Cardinal Parks was recently quoted by Law360 in their article “Airline Merger Trial Preparing For Takeoff in Bankruptcy Court.” The article discusses the upcoming suit that seeks to unwind the long-closed merger between American Airlines and U.S. Airways. The suit was originally brought by customers who claim that the merger between the two airlines is driving up ticket prices.

The case combines the rare private post-closing challenge with an unusual forum for antitrust actions. Mr. Parks spoke to Law360 about the potential conflict between practice areas that this remarkable case presents.

“If the judge finds anti-competitive effects and orders divestitures, then the antitrust laws will trump the bankruptcy law,” said Mr. Parks, “and the interests of consumers would be held to be more important than the interests of creditors.”

Mr. Parks is a member of Lewis Brisbois’ Antitrust & Competition Practice and has over 40 years of experience creating legal solutions to complex business problems, including counseling clients on antitrust and unfair competition issues, and assisting companies in reorganizing under Chapter 11 of the Bankruptcy Code.
