Frank Cerza to Speak at ICSC + U.S. Law Conference on Exclusive Use Clauses in Retail Leases

Phoenix, Ariz. (September 11, 2023) – New York Partner Frank Cerza will speak at the International Council of Shopping Centers (ICSC) U.S. Law Conference, hosted at the JW Marriot Desert Ridge Resort & Spa in Phoenix on October 26 at 10:30 a.m. PT.

Mr. Cerza’s 60-minute seminar, titled “Exclusive Uses: Balancing the Equities,” will focus on some of the various types of exclusive use clauses in today’s shopping center leases which impact a landlord’s ability to lease space in the future, and can have a chilling effect on competing tenant retailers. Mr. Cerza will be joined by Jason S. Gibson (Regency Centers) to explore the nuances of negotiating and drafting exclusives, including the breadth and reasonableness of the exclusive, finding the appropriate tenant mix, future rights, and the remedies available to both landlords and tenants in case of a breach. Mr. Cerza serves as chair of Lewis Brisbois’ Italy Practice, co-chair of the Real Estate & Land Use Practice, and as vice-chair of its Commercial Lending Practice. He focuses his practice on corporate and real estate business transactions and commercial finance, representing American and Italian companies and individuals in cross-border transactions.
