Beginning at 10:10 a.m., Ms. Edwards will join other panelists to present “Pandora’s Box Got Opened - Catch and Kill Agreements Gone Awry.” Their discussion will be inspired by the media coverage of the Stormy Daniels and Karen McDougal non-disclosure agreements. The panelists will cover a range of topics arising out of these agreements, including attorney professional liability and various types of insurance coverage for liability related to sexual harassment claims.
Also at 10:10 a.m., Ms. Ioannou’s will be part of a panel discussion titled “Shifting the Risk – How to Properly Draft Enforceable Indemnification and Limitations of Liability Clauses.” The talk will identify the different types of anti-indemnity laws that exist and how indemnification claims fare under each one, including the ‘Additional Insured’ loophole sometimes found in commercial contracts. It will also cover in detail the anti-indemnification statues of New York and Connecticut.
At 11:30 a.m., Mr. Friedman will join a panel titled “Insurance Application Fraud and Misrepresentation – What Is It, How to Spot It and How to Handle the Claim,” where he and other panel members will explore the different options for responding to and handling claims when the insured has provided false information on an application.
Later in the afternoon, at 3:25pm, Mr. Hoar will contribute to a panel discussion titled “Creating a Breach Response PLAN – Strategies for Prevention, Logistics, Action and Notification.” The panel will provide a roadmap for responding to a breach, highlight common mistakes, and provide tips on how to prepare yourself for the inevitable data breach.
