Christopher Ballod Comments on Cloud Agreements & CCPA for Legaltech News
(November 21, 2019) - Data Privacy & Cybersecurity Partner Christopher E. Ballod was recently quoted in an article from Legaltech news about the effects of the California Consumer Privacy Act (CCPA) on businesses’ cloud agreements. The article, titled “CCPA Uncertainty May Put Cloud Agreements Up in the Air,” discusses how a majority of companies with such agreements have not updated them to comply with the new law, which goes into effect on January 1, 2020.
Mr. Ballod noted that, with less than two months left in the year, some companies may not have enough time to “iron out all the mechanics involved in a cloud agreement” before the implementation date, such as how to properly satisfy subject data requests. He also warned of the CCPA’s new private right of action, which could lead to legal questions of liability between organizations that use cloud services and the companies that provide them.
“The risk is potentially uncapped,” said Mr. Ballod. “You have an unknown as to what litigation can end up looking like.”
