Brian Pokrywka to Join Strafford Webinar on Combating Plaintiffs' Reptilian Tactics

Pokrywka will join a Strafford CLE webinar on April 2 entitled "Combating Plaintiffs' Reptilian Tactics in Commercial Vehicle, Premises Liability, Products Liability, and Med Mal Cases." Beginning at 1:00 p.m. EDT, the live 90-minute webinar will guide litigators in recognizing and combating plaintiffs' use of tactics that leverage the "reptile theory."
The "reptile theory," which has gained traction among the personal injury plaintiffs' bar and well-prepared defense counsel, asserts that a party may prevail at trial by appealing to the primitive part of jurors' brains, which they share with reptiles. Because the reptile brain is conditioned to favor safety and survival, plaintiffs' attorneys use reptilian tactics to incite jurors' survival instincts and emotions, thereby gaining an advantage at trial and recovering sizable verdicts.
Mr. Pokrywka and his fellow webinar panelist will discuss how plaintiffs' attorneys use reptilian tactics in litigation. They will also describe how defense counsel can strategically identify and confront these strategies during discovery, deposition, voir dire, opening statement, cross-examination, and closing argument.
