Atlanta Team Obtains Dismissal for Celebrity Entertainer K. Michelle

Atlanta, Ga. (November 21, 2019) - Atlanta Partner Leron E. Rogers and Associate John T. Rose recently obtained dismissal of a breach of contract claim on behalf of our client Kimberly Michelle Pate (known professionally as K. Michelle) in an action filed in the Circuit Court of Maryland for Baltimore City. Ms. Pate is a nationally known singer, songwriter, and television personality.  

In his complaint, the plaintiff alleged that Ms. Pate had failed to honor their contract by failing to host and perform at a music concert in the city of Baltimore, Maryland, and that as a result of Ms. Pate’s alleged breach, he suffered significant harm. The plaintiff requested that the court order Ms. Pate to pay the plaintiff $1 million for his purported damages.

In turn, we denied the plaintiff’s allegations and filed a motion to compel dismissal on the grounds that the plaintiff was prohibited from pursuing his claims in the Circuit Court for Baltimore City. The court agreed with our argument, holding that that the plaintiff improperly sought to litigate his contract claim in court, and entered an order dismissing the action at the early pleading stage.
