The article looks at President Donald Trump’s selection of Judge Neil Gorsuch of the U.S. Court of Appeals for the Tenth Circuit to fill Justice Antonin Scalia’s vacancy on the U.S. Supreme Court. More specifically, it considers what Judge Gorsuch’s appointment could mean for the McDonnell Douglas test, a framework used in employment discrimination cases to determine whether an employee has offered sufficient circumstantial evidence to allow the claim to survive summary judgment and proceed to trial.
