Frank Toddre is a partner in the Las Vegas office of Lewis Brisbois and a member of the Insurance Coverage and Bad Faith Litigation Practices. He concentrates in the areas of Bad Faith Insurance Litigation, Sec 1983 Civil Rights Defense, Insurance Coverage Litigation, Personal Injury Defense, and Appellate litigation. Mr. Toddre has developed expertise in several subject matter fortes including catastrophic injury and wrongful death cases, product and premises liability, civil rights litigation, municipal defense, business and commercial tort cases, and gaming contract cases through his career in both private practice and public service. Mr. Toddre routinely litigates cases from cradle to grave, including all stages from initial valuation, pleadings, discovery, mediation, trial, and post judgment practice.

As a Senior Deputy Attorney General Mr. Toddre was one of the leading appellate and civil rights attorneys in the Ninth Circuit. Mr. Toddre is particularly proficient in the courtroom and has established a reputation as a respected advocate in Federal, State and Appellate Courts.

Mr. Toddre provided general legal counsel for several state entities, including the Departments of Correction, Wildlife, Taxicab Authority, and Solicitor General’s Office. He was the head of appellate litigation for NDOC and miscellaneous complex litigation matters. Mr. Toddre has appeared in over one hundred and fifty cases in the Ninth Circuit Court of Appeals and over one hundred cases at the Nevada Supreme Court/Court of Appeals. He has participated dozens of times for oral arguments in these Appellate Courts, having received three favorable published rulings in the Ninth Circuit for the matters of Cates v. Stroud 976 F.3d 972 (USSC Certiorari denied after writ petition briefing 20-1438), Evans v. Skolnik (997 F.3d 1060), and Nasby v. State of Nevada et al. No. 21-15044 (9th Cir. 2023). He also has appeared regularly in both Nevada and California federal and state courts, both as a government advocate and private Counsel, having taken several cases to favorable jury verdicts.

In prior private practice, Mr. Toddre obtained extensive experience defending both first party underinsured motorist claims and third-party adversarial litigation.  He has also become versed in drafting coverage opinions, business formation agreements, employee handbooks and procedures, sweepstakes, and contracts. He routinely performed contract reviews for restaurant sales, employment agreements, entertainment contracts, sweepstakes, and casino instruments. Following his admission to the Nevada Bar, he served a law clerk for the Honorable Judge Jennifer Togliatti in the Nevada Eighth Judicial District Court and completed an externship at the U.S. Attorney's Office Civil Division.

Mr. Toddre is a member of the Nevada State Bar Appellate Section, the Clark County Bar Association, and serves as a pro bono attorney with Legal Aid of Southern Nevada for the Children's Attorney Project.

Awards & Honors

Mr. Toddre is a 2021 recipient of the prestigious Jefferson B. Fordham Advocacy Award in Law Office Accomplishment from the American Bar Association Section of State and Local Government Law. The Nevada State Legislature passed two laws sponsored by the Office of the Attorney General and related to the Mr. Toddre’s Policy Research Team findings.
