Anthony C. Oceguera


Anthony Oceguera is a partner in the Sacramento office of Lewis Brisbois and a member of the Labor & Employment Practice. Mr. Oceguera has experience representing all types of employers, from single operator franchisees and small family-owned businesses to large companies operating in multiple states and countries. 

Mr. Oceguera represents employers in all aspects of labor and employment litigation, including State and Federal individual and class action cases, arbitrations, administrative claims before the Department of Labor and the California Labor Commissioner’s Office, discrimination charges before the U.S. Equal Employment Opportunity Commission and California Department of Fair Employment and Housing, unfair labor practice charges and union elections before the National Labor Relations Board and Agricultural Labor Relations Board, serious and willful and 132a petitions for increased compensation before the California Workers Compensation Appeals Board, and workplace safety complaints before Cal/OSHA. 

A large segment of Mr. Oceguera’s caseload involves the handling of complex wage and hour class actions, as well as representative actions under the Private Attorneys General Act. These cases are often the most perilous for employers of all sizes, as they allow a single individual to bring claims on behalf of all of business’s hourly employees, and often include tens of millions of dollars in potential damages. Additionally, Mr. Oceguera specializes in the defense of class actions brought against employers for allegedly unlawful background check policies and procedures under the Fair Credit Reporting Act and analogous state laws. Employers are often unaware of the numerous technical requirements associated with background checks, or assume that because they utilize disclosure and authorization forms provided by a Consumer Reporting Agency (“CRA”), that they are in compliance with the law. Mr. Oceguera works closely with his clients and with outside CRAs to ensure that background checks are done properly and in adherence with governing statutes and regulations and vigorously defends his clients when they are facing a nationwide class action targeting their background check practices.

Mr. Oceguera recognizes that not every client or case is the same, and spends significant time with clients and his team at Lewis Brisbois deciding on the proper strategy for achieving the best possible result based on the facts and evidence, and the client’s specific objectives. Mr. Oceguera has secured favorable outcomes for his clients, including early dismissals, judgments and confidential settlements.

Mr. Oceguera also provides counseling to employers in personnel matters and helps his clients in drafting and updating their written policies and procedures in order to maintain compliance with the ever-increasing requirements under California and federal law and avoid administrative complaints and lawsuits.

Mr. Oceguera is a graduate of University of California, Hastings College of the Law. While in law school, and for several years as a new attorney, Mr. Oceguera worked at a small plaintiff-side employment firm in San Francisco. Mr. Oceguera’s experience as a plaintiff attorney has been critical in honing his understanding of how plaintiff attorneys approach cases and what strategies are best employed to defend employers.

Prior to working at Lewis Brisbois, Mr. Oceguera was a partner at a Sacramento-based law firm that specialized at representing agricultural companies in California and Arizona, and worked closely with his clients to navigate the various legal challenges facing growers, shippers and farm labor contractors.

Mr. Oceguera is an avid sports fan, and in his off time enjoys attending his oldest son’s soccer games and swim meets, and watching the Golden State Warriors, Las Vegas Raiders and Oakland Athletics.
