Nanette Kalcik is a partner in the Wichita and Kansas City offices of Lewis Brisbois and is a member of the Labor & Employment and Complex Business & Commercial Litigation Practices. She has considerable experience in nationwide complex litigation and has spent her career protecting her clients’ interests throughout the entire litigation process—from pre-litigation consulting through trial and including the appellate process. As an experienced litigator and trial attorney, Ms. Kalcik has represented a wide range of clients in a variety of matters, including: complex civil litigation, commercial litigation, Title IX claims, medical malpractice disputes, tort and personal injury actions, oil and gas litigation, employment disputes, class action claims, municipal law, financial services litigation, and consumer and mortgage finance law. She has experience in bank and mortgage regulatory compliance, including compliance with and litigation involving the Truth in Lending Act, Fair Debt Collection Practices Act, Real Estate Settlement and Procedures Act, and Fair Credit Reporting Act. Ms. Kalcik also provides proactive, strategic advice and counsel to employers regarding employment practices in the ever-changing landscape of COVID-19 (including compliance with OSHA mandates, vaccination polices and exemptions, and remote work). She utilizes her unique skillset to guide clients through OSHA related issues and litigation, including facilitating the appeal process and negotiations following inspections and citations to reach resolution.
Ms. Kalcik brings a unique perspective to our firm, having clerked for the U.S. District Court for the District of Kansas for several years after graduation and prior to entering private practice. She joins Lewis Brisbois with years of litigation experience and a wealth of knowledge about the various stages of litigation and is able to quickly identify potential pitfalls for clients along the way.
Ms. Kalcik believes in adding value to each case she handles. Her goal in representing clients in litigation is to provide the best representation possible while realistically assessing potential outcomes and risks. She achieves this goal by evaluating a number of considerations in pre-litigation and the early stages of litigation, including client expectations, weaknesses in the client’s position, anticipated fees and costs if litigation is pursued, and the opposing party’s desired outcome. This early assessment process often prevents clients from expending substantial fees and expenses on matters that either should not be litigated because of extraordinarily high risk or because of the opposition’s relatively modest objectives. She has been effective in obtaining early resolution of disputes through strategic and dispositive motion practice or alternative dispute resolution.
Ms. Kalcik has practiced and is licensed in Kansas, Illinois, Missouri, and numerous federal courts.
