David Hargis is a partner in the Houston office of Lewis Brisbois.
David maintains a diverse practice that includes complex commercial litigation, securities litigation and arbitration, labor and employment and real estate/construction transactions and litigation. David was born and raised in South Louisiana and moved to Houston as a teenager. His Cajun roots combined with his outgoing personality enable him to forge lasting relationships with his clients. David prides himself on providing practical guidance as effectively and efficiently as possible.
David has represented an array of businesses and individuals in a variety of commercial disputes. These disputes have ranged from simple breach of contract and collection cases to complex commercial transactions involving breach of fiduciary duty, shareholder disputes, officer and director liability, trade secrets, and insurance coverage claims.
Securities Litigation & FINRA
David represents broker-dealers and brokers in both customer and industry FINRA arbitrations. David’s understanding of the FINRA arbitration process enables him to develop each case efficiently, and proceed to an arbitration hearing when necessary. David also provides guidance to brokers considering a transition to a new firm. Non-Competition/ non-solicitation agreements, employee forgivable loans, and deferred compensation are common issues when a broker decides to move to a new firm.
Real Estate, Land Use & Environment
From entity formation, to negotiating terms of a purchase agreement, to various due diligence items such as title and environmental issues through the closing of the transaction, David has handled every aspect of complex real estate transactions. David has handled several landlord-tenant disputes, construction contract disputes, a variety of mechanic’s and materialmen’s liens, and resolved eminent domain issues and title disputes following foreclosure and bankruptcy. David regularly negotiates commercial leases for his clients, the most notable of which were a new warehouse lease for an industrial coatings company, an office lease for a technology company, and several medical professional clinic and office space leases. Importantly, David also has extensive experience negotiating with lenders on behalf of his clients.
David’s wife Amy is also a lawyer handling pharmaceutical claims and representing commercial property owners in first-party insurance disputes. Together, they enjoy spending time with their two children, traveling, cooking, playing tennis, running, spending time at the lake, and trying new restaurants. David is an avid Houston sports fan and is always prepared to debate Astros lineup tweaks, Rockets roster moves, and the Texans secondary situation.
