Colby M. Everett


Colby M. Everett is an associate in the Kansas City office of Lewis Brisbois and a member of the Labor & Employment, Healthcare Regulatory & Compliance, and General Liability Practices. He represents and counsels clients nationwide on employment policies, employment disputes, non-compete and non-solicitation disputes, corporate espionage, and trade secret litigation. Colby works with clients across a spectrum of private industry including pharmaceuticals, nursing, scientific testing, higher education, telecommunications, software development, petroleum products, real estate, and insurance.

A fierce advocate, Colby takes personal interest in protecting his client’s most valuable assets when threatened. He has experience defending, pursuing, and winning injunctive relief against outside actors in state and federal courts nationwide. And, he has extensive knowledge on data forensics: an integral part of trade secret litigation. Colby is an experienced counselor and litigator on Title IX, Title VII, and similar state laws. In higher education litigation, Colby knows the Family Education Rights and Privacy Act, and related regulations, and is well-equipped to protect the educational institutions he defends.

Colby also represents compounding and specialty pharmacies, healthcare providers, and medical spas navigating state and federal regulatory schemes. He is well-versed on FDA and state board of pharmacy inspections; lobbying state and federal government on pharmaceutical issues; the Federal Food, Drug, & Cosmetic Act; the Drug Quality and Security Act; Compounding Quality Act; Domestic Memorandums of Understanding; DEA regulations, including Diversion Control; Stark and Anti-Kickback statutes; Business Associate Agreements; Compounding Service Agreements; and navigating legal issues implicated by the patient, pharmacy, provider relationship. Colby believes that private healthcare, and its attorneys, are the first line of defense to state and federal regulatory overreach.

Additionally, Colby represents several major real estate companies across the Midwest. He advises on property management; landlord and tenant relationships; and federal, state, and municipal housing fairness. Colby enjoys counseling clients on real estate issues and defending his clients in litigation.

Colby always endeavors to manage his clients’ front-end risk to mitigate their back-end exposure. He excels at leveraging procedure to the advantage of his clients and disposing of high-exposure matters early in litigation. Colby is a team player in litigation, providing his clients with responsive and cost-effective representation. Colby is also a team player in the firm, regularly planning and arranging the firm’s team-building and social events. He loves bringing people together for brainstorming, laughs, and all-around fun.

Colby is a graduate of the University of Kansas School of Law where he served as Editor-in-Chief of the Kansas Journal of Law & Public Policy, and published on issues in First Amendment and social media policy. He also represented the University at national trial competitions and was the recipient of mock trial awards. In his free time, Colby enjoys riding adventure motorcycles cross country, fitness, shooting multi-gun competitions, riding mountain bikes, hiking, fly fishing, snowboarding, and spending time with family and friends.
