The Lewis Brisbois eDiscovery Practice, through our proprietary approach to litigation management processes via our firm’s CE2eDS (Cost Effective, Cutting Edge eDiscovery Solutions) program, supports and confirms that commitment. Our primary goal is to keep the cost of examining the exponentially increasing volume of electronic data associated with modern litigation affordable. As a result, our clients are able to take advantage of the people, process, and technology that avoids or reduces expenses impacting their bottom line.

How do we do it? We start by determining what is proportional to the issues in the case in terms of data volume and total eDiscovery spend. We do not let data volume alone define eDiscovery spend. Finding the likely responsive data without looking at non-responsive information and looking at only as much likely responsive data as is justified from a cost benefit analysis is the goal. Workflows apply analytics to data while it still exists as extracted text and metadata. This avoids bloating the data with unnecessary processing and keeps the data footprint as small as possible. We only promote for review the data that can be reviewed in the current month and non-responsive data is moved to low cost storage. We stop review when a defensible volume of data has been analyzed. This is a unique and cost-effective approach compared to many of our peers. The industry standard is to process all eDiscovery data as soon as it is received, which often results in large volumes of non-responsive data being processed and hosted at high costs while nothing is being done with it. This can be as unproductive as renting a suite at the Ritz and sleeping at a Motel 6. This is one reason why overall eDiscovery costs can skyrocket far past initial budget estimates.

The CE2eDS approach starts from a wiser position of strength. Our team delivers the right technology for the project because the first thing we do is ask the fundamental questions to help accurately identify and determine low cost options without sacrificing functionality or operational skill. We then leverage any number of the exclusive deals we maintain with more than 30 technology providers throughout the eDiscovery space.  Some are software development companies, some offer outsourced review, others offer full service collection to production, and many fall in between.  We have strong and ongoing relationships with the senior management at all of them. These relationships allow us to get custom solutions not available to others, and to give our clients the best price while developing a unique, collaborative, and cost effective workflow. When needed, we create virtual eDiscovery technology providers using the strengths of two or more companies to provide optimal solutions to clients.

    Prior to attending law school, Mr. Metz spent four years working as a Paralegal. First in the Creditors Rights field then as a Corporate Paralegal working in house for one of America's top ten largest convenience store companies. This background provided Mr. Metz with the tools that he needed to thrive in law school.

    While attending law school at Chase College of Law at Northern Kentucky University, Mr. Metz published a student note in the 49th Volume of the Northern Kentucky Law Review before being elected as the Editor-In-Chief for its 50th Volume. Mr. Metz is also an active member of the NKY Law Review's Alumni Association.

    After graduating from the Chase College of Law, Mr. Metz took the Ohio bar exam and was sworn into the Supreme Court of Ohio to become a licensed attorney in the Ohio. Thereafter, Mr. Metz and his family moved to South Charleston, WV and he was promptly sworn into the Supreme Court of West Virginia. As a young attorney, Mr. Metz became enthralled with work in the Labor and Employment field and worked with a firm that represented both employees and employers in their Labor and Employment disputes. During his early years of practice, Mr. Metz worked with individual primary from the medical field in and around the Charleston area. He additionally assisted clients with Workers Compensation and unemployment filings.

    Mr. Metz has practiced, and continues to practice, in state and federal courts representing civil defendants in disputes concerning labor and employment law, personal injury law, contracts law, and products liability law throughout West Virginia. Mr. Metz has also litigated, and continues to litigate, numerous insurance coverage disputes and bad faith lawsuits throughout West Virginia.

    Chris Hawk is a partner in the Portland office and a member of the Labor & Employment and Professional Liability Practices. Chris is a seasoned civil defense litigator with significant experience handling all aspects of litigation; from the initial demand through trial and appeal. 

    Chris' expansive labor and employment practice focuses on defending employers of all sizes against claims alleging retaliation, harassment, discrimination, and other civil rights claims, as well as wage and hour violations.     Alexander Higginbotham is an associate in the Kansas City office of Lewis Brisbois and is a member of the Labor & Employment Practice.

    Alexander is a 2018 graduate of the University of Missouri, where he graduated Phi Beta Kappa with Bachelor of Arts degrees in Political Science and Sociology, a Minor in History, and a Certificate in Constitutional Democracy. He graduated with his Juris Doctorate in 2021 from the University of Missouri Kansas City School of Law. 

    Upon finishing law school, he worked at the Clay County Prosecuting Attorney's Office, where he served as an Assistant Prosecuting Attorney and as Public Information Officer. As a prosecutor, Alexander litigated a wide variety of cases, ranging from civil actions to enforce, establish, or modify orders for child support to criminal prosecutions of violent felonies. As Public Information Officer, he served as the official spokesperson for the office, drafting press releases, organizing press conferences, and responding to all media or public inquires. 

    During law school, Alexander served on the UMKC Law Review, finished first place and received "Best Closing Argument" in the 1L Mock Trial Competition, served as the Chief Justice of the UMKC Student Supreme Court, as a committee chair in the Student Bar Association, on the Steering Committee for the FBI Student Academy, and as the president/magister of the Powell Inn chapter of Phi Delta Phi. He also completed internships in the chambers of the Honorable Roseann A. Ketchmark at the U.S. District Court for the Western District of Missouri, in the U.S. Attorney's Office, and at the Jackson County Prosecutor's Office. 

    In 2024, Alexander joined the litigation team at Lewis Brisbois where he now brings his passion for advocacy and experience in the courtroom to deliver results for clients.

    Danielle K. Little is a partner in the San Bernardino office of Lewis Brisbois and a member of the General Liability and ADA Compliance & Defense Practice Groups. Ms. Little has extensive experience handling complex tort, labor and employment, premises liability, landlord tenant, ADA compliance, auto liability, public entity liability, business litigation, real estate, contractual disputes, appellate and criminal defense matters. Ms. Little's practice has included the representation of both plaintiffs and defendants. 

    Prior to entering civil litigation practice, Ms. Little served as an Assistant District Attorney for the Kings County District Attorney's office in Brooklyn, New York. There, she handled appeals, federal writs of habeas corpus petitions and second chaired serious felony cases. She then worked for several law firms handling products liability, employment and civil rights litigation.

    Besides practicing law, Ms. Little’s other passions include teaching and writing. She supported herself in law school by serving as a credentialed K-12 public school teacher.  After law school, Ms. Little attended Sarah Lawrence College and obtained a Masters of Fine Arts degree, with a concentration in Creative Non-Fiction. Her written work has been published in The New York Law Journal, Diversity & the Bar Magazine, QBR: The Black Book Review and several literary publications. Ms. Little has also served as an Adjunct Assistant Professor at Long Island University and as an Adjunct Lecturer at City University of New York - Queens College, where she taught undergraduate Composition and Literature courses.
