Lann G. McIntyre is a partner in the San Diego office of Lewis Brisbois and a vice-chair of the Appellate Practice group. Ms. McIntyre has over 35 years of experience first as a civil litigator and then as an appellate specialist. Ms. McIntyre represents both public and private clients in civil writs, appeals and mandate proceedings. She has briefed and argued cases in the Third, Fifth, and Ninth Circuit and every appellate court in California. Ms. McIntyre is certified by The State Bar of California Board of Legal Specialization as a specialist in appellate law and is one of fewer than 40 attorneys certified as an appellate specialist in San Diego County.

Her experience includes representing municipalities, cities, counties and other public entities in writs and appeals. She has also represented corporate and individual clients in a wide range of substantive areas of law including healthcare, elder abuse, employment, personal injury, government claims, anti-SLAPP, police excessive force, attorney professional negligence, and family law. Ms. McIntyre also prepares amicus briefs on behalf of public and private entities in state and federal appellate proceedings.

Recently, Ms. McIntyre has been at the forefront of defending nursing homes in matters arising from the COVID-19 pandemic, successfully devising and executing responses on behalf of firm clients since the earliest pandemic-related court actions were filed. She works closely with clients and claims professionals to invoke the protections of the Public Readiness and Emergency Preparedness Act (PREP Act) and other defenses to claims filed in jurisdictions nationwide. Similarly, she has led appeals in several circuit courts across the country, seeking to obtain the broadest possible protections for the firm’s clients. Ms. McIntyre also has served as embedded appellate counsel in pandemic-related cases involving nursing homes in various jurisdictions, successfully garnering amicus support in appeals from such significant groups as the U.S. Chamber of Commerce, the California Association of Health Facilities, and the American Health Care Association.

In addition to appellate briefing and oral argument, Ms. McIntyre has acted as embedded appellate counsel during trial and has extensive experience in working with trial lawyers to achieve success and preserve the record before, during, and after trial through dispositive motions, trial briefing, in limine motions, and post-trial motion work.
