Lewis Brisbois' Sustainable Development & Green Technology Practice, lead by Rene Gamboa, LEED AP, builds on our attorneys' knowledge and experience in real estate development, land use law, and intellectual property, and brings a multidisciplinary approach to the emerging fields of sustainable development and green technology. Several members of the Sustainable Development and Green Technology Group have been accredited by the U.S. Green Building Council as Leadership in Energy and Environmental Design Accredited Professionals (LEED AP). Lewis Brisbois intellectual property lawyers also team with businesses in developing products, processes, and methods tied to this emerging economy. By harnessing various areas of experience, the group has been able to assist clients in meeting sustainable developments and green technology objectives.

The attorneys of our Sustainable Development and Green Technology Practice have represented clients on a variety of issues, including: financing and business expansion for energy and utilities companies; government regulatory compliance; land, water use, zoning and various other real estate transactions; waste management; environmental and construction litigation; patent, trademark, trade secret, and copyright protection for energy and related green technologies.

With offices throughout the United States, the Sustainable Development and Green Technology Practice leverages the national and local experience of its attorneys to provide a wide range of services for its clients, including:

  • Architect/Engineer:  Green and LEED certification issues (failure to qualify projects, missing credits for energy, environment, sustainability, material use and recycling, design, project control and effectuation)
  • Environmental:  Certification, Brownfield and Greenfield projects, water issues, habitat issues, EPA
  • Construction:  Certification issues, failure to process credits, failure to comply and loss of credits, failure to meet deadlines or zoning requirements
  • Decertification issues:  contracts, insurance coverage, performance bonds, architects and engineers liability
  • Consulting:  LEED AP consultation, project administration, contract review, coordination among teams, government regulatory issues regarding compliance, obtaining tax and energy credits and benefits
  • Project Administration:  LEED AP to administer credits, review all documents and coordinate submission of paperwork, write documents and appeals for credit interpretation requests
  • Legal Review:  LEED AP can review for certain thresholds for contract, submissions, compliance, energy standards, design standards
  • Liaison with Government Agencies and Contractors:  assist with meeting building and construction standards and obtaining credits, interface with Government Agencies, Government Green Team Groups, and clients
  • Consulting:  AB 811 Renewable Energy and Retrofit Financing
  • Intellectual Property Protection:  Patent, trademark and copyright prosecutors and litigators with science backgrounds and experience in energy and sustainable development technologies.
