Julie Maurer, James Duncan Published in The Transportation Lawyer

(May 15, 2018) - Phoenix Partner Julie Maurer and Associate James Duncan co-authored an article featured in the April 2018 issue of The Transportation Lawyer, the national publication of the Transportation Lawyer Association.

The article, “The Preemptive Power of the FAAAA – A Future in Decline?” examines some of the most recent federal decisions interpreting the preemptive scope of the Federal Aviation Administration Authorization Act (FAAAA) as to freight brokers, and notes an inconsistent, if not declining, preemptive effect on state laws and regulations. The article also analyzes proposed legislative efforts to both expand and contract the preemptive effect of the FAAAA.
