Josh Aicklen, David Avakian Secure Defense Verdict

Las Vegas Partners Josh Cole Aicklen and David B. Avakian recently secured a unanimous defense verdict in a personal injury suit against a nightclub.

The plaintiff was dancing at the nightclub and tripped and fell on a two-step staircase as she was leaving. She fractured her arm, tore a knee ligament, and ruptured a disc in her lower back, and subsequently sued the nightclub seeking millions of dollars.

During a two-week trial, we argued that the staircase wasn’t dangerous and that the plaintiff fell because she wasn’t paying attention.

After little more than an hour of deliberation, the jury returned an 8-0 verdict against the plaintiff.
