Bill Helfand, Norm Giles Named Appellate Lawyers of the Week
Houston Partners William Helfand and Norman Ray Giles were recently named appellate lawyers of the week by the Texas Lawyer after a Texas appellate court tossed a lawsuit against an off-duty police officer who broke up a bar fight.
The police officer was sued for assault after breaking up the fight while working a security job at a sports bar. The officer responded by asserting official immunity, and the trial court granted his motion to dismiss. The plaintiff appealed the decision, but the appellate court held that the police officer’s immunity covered him while he was working the off-duty job.
“We felt the evidence was pretty compelling both at the trial and the appellate court level that the officer would not have taken the action if he did not think a crime was in progress and that he was obligated to address it,” Helfand told the Texas Lawyer.
