Chris Nevis and Lauren Koblitz Obtain Summary Judgment in Favor of Shopping Mall

San Francisco Partner Chris Nevis and Associate Lauren Koblitz successfully obtained summary judgment in favor of their client, a shopping mall, in a significant exposure personal injury case filed by a plaintiff who sustained chipped teeth, facial lacerations, and back and neck injuries when he tripped and fell while he was walking at the shopping mall. Specifically, plaintiff tripped over a bright yellow electrical box located within a tree-well that was adjacent to the pedestrian pathway. The Court agreed with our analysis that the shopping mall could not be held liable to plaintiff because there was undisputed evidence to demonstrate that plaintiff's sole negligence was the cause of his injuries in that he, without looking, stepped into the tree-well and tripped over the raised electrical outlet that was painted bright yellow. Further, the Court also agreed that there was no evidence of the existence of a dangerous condition on the property .
