Jason Wright is a partner in the Atlanta office of Lewis Brisbois and a member of the Commercial Litigation and Business Practices Departments. Mr. Wright has more than 20 years of experience handling a broad range of complex civil litigation before Georgia and Kentucky state courts and the United States District Court for the Northern District of Georgia and United States District Court for the Western District of Kentucky (including both first and second chair in jury trials); appeals before the United States Eleventh Circuit Court and United States Sixth Circuit; petition for certiorari to the United States Supreme Court. He has represented parties in condemnation actions (including declaration of taking, assessor panel, special master hearings and first chair in jury trials); government representation and municipal utility law; commercial and business litigation (including contract, corporate, trademark/tradename, environmental, estates & wills, personal injury, creditor’s rights, sexual harassment, real estate litigation, contract, insurance,); administrative hearings; regulatory compliance healthcare issues; construction litigation; health care law (litigation and Certificate of Need issues); and employment litigation.

Prior Experience

  • Private Property Owners and Developers. Mr. Wright served as counsel representing various property owners and developers regarding condemnation of various rights and interests in many different types of properties.
  • Environmental Disputes. Mr. Wright served as counsel representing multiple property owners in regard to contamination of private property by neighboring property owners.
  • Construction. Mr. Wright has represented contractors, subcontractors and owners in construction defect and breach of contract claims.
  • Creditor Rights. Mr. Wright has represented various lending institutions and purchasers of defaulted loans in enforcing the debt obligation, including confirmation of foreclosures, appointment of receivers, suits on note and post-judgment collection.
  • Administrative Proceedings. Mr. Wright has represented private parties in a variety of administrative and regulatory matters, including professional licensures, Medicaid reimbursement, certificate of need applications, environmental permit violations, and rate tariff applications.
  • Personal Injury. Mr. Wright has represented private parties:
    • Fifth Runway Expansion, City of Atlanta. Mr. Wright served as counsel to the City of Atlanta in connection with the acquisition of properties for the Fifth Runway Expansion at the Hartsfield-Jackson International Airport. This expansion project involved a reported $4.4 billion improvement and the fee simple acquisition of more than 200 individual properties outside the jurisdictional boundaries of the City.
    • Georgia World Congress Center, State of Georgia. Mr. Wright served as counsel to the State of Georgia and the Georgia World Congress Center in connection with the acquisition of multiple properties for the expansion and development of parking facilities at the Convention Center and Georgia Dome. This expansion project involved the taking of commercial and residential properties and, in addition to constitutional and other issues regarding a fee simple taking, our attorneys have dealt with novel business loss issues. Our attorneys handled cases for the State which created outstanding legal precedent in the area of billboard takings.
    • Atlanta Development Authority, Downtown Development Authority, City of Atlanta. Mr. Wright served as counsel to the Downtown Development Authority, City of Atlanta, in connection with the English Avenue Redevelopment Project and the Southside Redevelopment Project. These projects involved the fee simple acquisition of properties in connection with an approved redevelopment plan for mixed use commercial/ light industrial and residential. These projects and the takings were under the Georgia Redevelopment Powers Law.
    • Welcome All Road Booster Pump Station, City of Atlanta. Mr. Wright served as counsel to the City of Atlanta in the fee simple takings of several properties for a construction site for a booster pump station.
    • Lakewood Redevelopment Project, City of Atlanta. Mr. Wright served as counsel to the City of Atlanta in the fee simple takings in connection with the approved Lakewood Redevelopment Plan for mixed-income residential property development.
    • Capitol Homes Revitalization, Atlanta Housing Authority. Mr. Wright served as counsel to the Atlanta Housing Authority in takings for the revitalization of the Capitol Homes public housing development.
    • Harris Homes Revitalization, Atlanta Housing Authority. Mr. Wright served as counsel to the Atlanta Housing Authority in takings for the revitalization of the Harris Homes public housing development.
    • Dam Improvement Project, Atlanta Housing Authority. Mr. Wright served as counsel to the Atlanta Housing Authority in takings for the Dam Improvement Project. This project dealt with the acquisition of necessary rights for the restoration and improvement of a lake, spillway and dam at the Wildwood Lakes Project site.
    • Nancy Creek Deep Tunnel Sewer Project. Mr. Wright served as counsel to the City of Atlanta in fee simple takings for the staging sites for the Nancy Creek Deep Tunnel Sewer Project.
  • Mr. Wright represented the City of Atlanta in condemnations for easement rights in various public works projects. In the City’s CSO Projects, pursuant to a Consent Decree in the United States District Court for the Northern District of Georgia, the City is engaged in sewer projects with budgeted costs totaling in excess of $971,000,000 and anticipated costs to exceed $3,000,000,000. Mr. Wright served as counsel to the City in the acquisition of easements in over 30 such condemnation proceedings. Mr. Wright represented the City in defending against the very first challenges to the recently enacted provisions permitting the use of the declaration of taking method of condemnation for publicly owned utilities.
    • Nancy Creek Project, City of Atlanta. Mr. Wright served as eminent domain counsel to the City in the acquisition of multiple easement rights in the Nancy Creek Area, which rights are necessary for staging deep tunnel projects.
    • South Fork Sewer Project and North Fork Sewer Project, City of Atlanta. Mr. Wright served as eminent domain counsel to the City in the acquisition of multiple easement rights in the South Fork Sewer Project and North Fork Sewer Project. These projects involve permanent easements for sewer and access and temporary easements for construction and construction of sewer upgrade to the sewer system trunk line, including use of tunneling for construction without surface disturbance.
    • Peachtree Interceptor Sewer Project, City of Atlanta. Mr. Wright served as eminent domain counsel to the City in the acquisition of multiple easement rights from property owners in connection with the Peachtree Interceptor Sewer Project. This project involves the acquisition of permanent easements for sewer and access and temporary construction easements for sewer upgrades to the sewer trunk line and siphon site.
    • Indian Creek Drainage Improvement Project, City of Atlanta. Mr. Wright served as eminent domain counsel to the City in the acquisition of multiple easement rights from property owners in connection with the Indian Creek Drainage Improvement Project. This project involves the acquisition of permanent easements for sewer and access and temporary construction easements for sewer upgrades to the sewer system trunk line.
    • Veteran’s Hospital Project, City of Atlanta. Mr. Wright have served as eminent domain counsel to the City in the Veteran’s Hospital Project. This project involved the acquisition of permanent easement rights for server and access and temporary construction easements for sewer upgrades to a sewer trunk line.
    • Westside Combined Sewer Project, City of Atlanta. Mr. Wright served as eminent domain counsel to the City in the Westside Combined Sewer Project. This project involved the acquisition of permanent easement rights for sewer and access and temporary construction easements for sewer upgrades to a sewer trunk line with a chlorination system.
    • 10th Street Trunk Sewer Project, City of Atlanta. Mr. Wright served as eminent domain counsel to the City in the 10th Street Trunk Sewer Project. This project involved the acquisition of permanent easement rights for sewer and access and temporary construction easements for sewer upgrades to the sewer trunk line.
    • Bennington Towers Project, City of Atlanta. Mr. Wright served as eminent domain counsel to the City in the Bennington Towers Project. This project involved the acquisition of a permanent easement for an existing sewer line erroneously located by a developer on private property.
    • MLK/Fairburn Road Project, City of Atlanta. Mr. Wright served as eminent domain counsel to the City in the MLK/Fairburn Road Project. This project involved the acquisition of multiple easement rights of way, slope easements, driveway easements and temporary construction easements for widening and realignment of the intersection. Many of these condemnations involved claims for business losses.
    • Fairburn at CSX Bridge Project, City of Atlanta. Mr. Wright served as eminent domain counsel to the City in the Fairburn at CSX Bridge Project. This project involved the acquisition of a necessary right of way, slope easements, driveway easements, and temporary construction easements for road improvement and bridge replacement.
    • Memorial Drive/Boulevard Project, City of Atlanta. Mr. Wright served as eminent domain counsel to the City in the Memorial Drive/Boulevard Project. This project involved the acquisition of easement rights of way, slope easements, driveway easements and temporary construction easements for intersection improvement of the Oakland Wall collapse. These condemnations involved claims for business losses.
    • Campbellton Road Project, City of Atlanta. Mr. Wright served as eminent domain counsel to the City in the Campbellton Road Project. This project involved the acquisition of easements for rights of way, slope easements, driveway easements and temporary construction easements for a road improvement project.
    • Lakewood Avenue Project, City of Atlanta. Mr. Wright served as eminent domain counsel to the City in the Lakewood Avenue Project. This project involved the acquisition of easements for rights of way, slope easements and temporary construction easements for road improvement and bridge replacement.
    • Roxboro Road Widening Project, City of Atlanta. Mr. Wright served as eminent domain counsel to the City in the Roxboro Road Widening Project. This project involved the acquisition of easements for rights of way, slope easements, driveway easements and temporary construction easements for the road widening at Roxboro Road, including multiple shopping center developments.
